3S National Defense Authorization Act (NDAA) Compliance

INTRODUCTION

The signing of the National Defense Authorization Act (NDAA) on August 13, 2018, U.S. government agencies or U.S. official partners are prohibited from using technologies and equipment that threaten U.S. national security’s. U.S. federal government agencies and federal funded organizations are prohibited from purchasing or installing equipment and services of these Chinese companies (Huawei, ZTE, Hytera Communications, Hikvision, Dahua Technology) and their specific video surveillance product suppliers, system suppliers and component (chip) suppliers .
On August 13, 2019, the US government issued the Interim Regulations (NDAA) Section 889(a)(1)(A). The law further expanded the ban on the use of basic components such as Huawei HiSilicon chips.

NDAA Summary

◆ It is forbidden for any government agency to purchase or sign a contract to purchase “video surveillance equipment (including semi-finished products)" produced by the following companies:
● Hainengda Communication Co., Ltd.
● Hangzhou Hikvision Digital Technology Company
● Dahua Technology Company

◆ It is forbidden for any government agency to purchase or contract to purchase "telecommunications equipment" produced by the following companies:
● Huawei Technologies
● ZTE Corporation

◆ It is forbidden for any government agency to purchase or contract to purchase "telecommunications equipment" produced by the following companies:

● ZTE Corporation

It is forbidden for any government agency to purchase or contract to purchase "components/chips" produced by the following companies :
● Hisilicon Semiconductor Co., Ltd.

After the US government announced 28 trade blacklists on October 7, 2019, it announced an additional 33 firms and businesses added to the trade blacklists on May 22, 2020. In addition to the Chinese security companies Hikvision, Dahua Technology, Huawei , ZTE, and Hytera Communications, IFLYTEK, Megvii, SenseTime, Xiamen Meiya Pico, Qihoo. The additional thirty-three Chinese companies added include, 360 (Qihoo360), NetPosa, CloudWalk, FiberHome, and CloudMinds.

The above laws and regulations clearly regulate that the United States and the United States federal agencies shall prohibit the sale and purchase from August 2020, and prohibit the installation from August 2022.
● This law prohibits the purchase of any equipment owned by or controlled by entities associated with the Chinese government.
● Contractors are forbidden to provide any telecommunications equipment or services covering specific Mainland Chinese companies as a substantial or necessary part of equipment, systems, services or key technologies.
● If the surveillance camera or system is provided under another brand, but the brand is also controlled by one of these list suppliers, the NDAA ban will be extended to these other suppliers or manufacturers.
● NDAA also bans "mandatory components of any system" and "key technologies as part of the system" for manufacturers listed on the list.

3S is pleased to affirm that our main 3S product portfolio with products targeted to US government entities, enterprise businesses and their contractors and affiliates, is NDAA-compliant.

While non-government entities are not required to comply with the NDAA, for small business owners concerned about potential broader implications of this law, the 3S video surveillance solution does offer camera options that are NDAA-compliant as well. Additionally, 3S is working on a related new recorder that meets NDAA compliance, to be released in 2020.

The following 3S cameras and network video recorders (NVRs), which do not use or deploy critical components including SoCs produced by NDAA banned component vendors, are compliant with the NDAA. These products will be included in 3S’s GSA contracts and are recommended for US Government applications that are subject to the NDAA.
